been trying to activate ACF pro was using the free version and noticed that there is a version that comes with the theme so I deactivated and deleted the free version and installed the ACF pro version from the xtheme plugin page. it does not activate now. am I missing a step?

ACF Pro comes bundled with X and Pro so you can still use them without needs to activate them using a license.
But if by activating, you mean you are not able to activate the actual plugin in the admin area, try deleting the plugin through FTP. Then reinstall it in the admin.
